House Construction Permit



Obtaining a house construction permit in Bengaluru is a multi-step process that involves getting approval from the relevant municipal authority and other government departments. The primary authority is the Bruhat Bengaluru Mahanagara Palike (BBMP), but depending on the location and project size, you may also need approval from the Bangalore Development Authority (BDA) or other local bodies like the Bangalore Metropolitan Region Development Authority (BMRDA).

1. Preparation and Documentation 📝

Before you even submit an application, you must have all your documents in order and a professionally prepared building plan.

  • Jurisdiction Check: First, confirm whether your property falls under the jurisdiction of the BBMP, BDA, or another authority. The process and specific rules can vary slightly between them.

  • Hire a Professional: You must engage a licensed architect or a structural engineer registered with the BBMP to create your building plan. The plan must adhere to the latest Bangalore Building Bye-laws and zoning regulations.

  • Building Plan: The plan must include detailed architectural drawings, structural designs, site plans, floor plans, and elevation drawings. It should also show things like the setback areas, Floor Area Ratio (FAR), and parking space.

  • Document Checklist: Gather all the necessary documents. This is a crucial step, and any missing or incorrect document can lead to delays or rejection. Common documents include:

    • Khata Certificate & Extract: This is the legal document proving ownership and is essential for all property-related transactions and tax payments.

    • Title Deed/Sale Deed: Proof of ownership of the property.

    • Latest Property Tax Receipts: Proof that you have paid all property taxes up to date.

    • Encumbrance Certificate: This ensures that the property is free from any legal or monetary liabilities.

    • Survey Sketch: A map issued by the Department of Survey and Land Records showing the exact boundaries of your plot.

    • ID Proof: Aadhaar and PAN cards of the property owner(s).

    • Structural Safety Certificate: From a qualified structural engineer.

    • No Objection Certificates (NOCs): Depending on the project, you may need NOCs from various departments, such as the Fire Department (for buildings over a certain height), Airport Authority of India (if near an airport), Bangalore Water Supply and Sewerage Board (BWSSB), and Bangalore Electricity Supply Company (BESCOM).

2. Application Submission and Scrutiny 💻

The application process is mostly online now, which has significantly reduced the time and effort required.

  • Online Application: You'll submit your application through the BBMP's online portal, often with the help of your registered architect. You'll need to upload the building plan in CAD format and all the required documents.

  • Fee Payment: Pay the applicable fees online. The total fee is calculated based on several factors, including the guidance value of the property, the built-up area, and project type. This can include scrutiny fees, development charges, betterment charges, and labor cess.

  • Automated Scrutiny: Once submitted, the system performs an automated check of your building plan against the bye-laws. If any violations are found, the system will flag them, and you'll have to correct the plan and resubmit it.

  • Manual Verification: If the plan passes the initial automated check, a municipal officer will manually verify all the uploaded documents and the plan's compliance.

  • Site Inspection: An Assistant Engineer and other officials may conduct a physical inspection of your plot to verify the details provided in the application, such as the plot boundaries, road width, and existing structures.

3. Approval and Permit Issuance ✅

  • Final Approval: After all verifications are complete and no issues are found, the relevant authority (e.g., the Assistant Director of Town Planning or Joint Commissioner) will give the final approval.

  • Permit Issuance: The building plan approval and license are generated online, and a soft copy is sent to the applicant. This document is your official permit to begin construction. The permit is typically valid for 3-5 years.

Important Considerations

  • Small Plots: The BBMP has a "Suvarna Paravanige" (Golden Permit) system for residential plans on sites up to 4,000 sq. ft., which is a faster and more streamlined process.

  • Occupancy Certificate (OC): After construction is complete, you must apply for a Commencement Certificate and an Occupancy Certificate (OC). The OC confirms that the building has been constructed in accordance with the sanctioned plan. Without it, the building is considered illegal, and you may face issues getting utility connections. However, there is an exemption for houses on plots of 1,200 sq. ft. (30x40 feet) or less, provided the building is no more than ground plus two floors or stilt plus three floors.

  • Compliance: You must stick to the approved plan. Any deviation can lead to penalties, fines, or even a demolition order. If you need to make changes, you'll have to apply for a revised plan approval.
